Regulation 77 – Conservation of Habitats and Species Regulations 2017
Regulation 75 of the Conservation of Habitats and Species Regulations 2017 imposes a condition on any permission granted by the General Permitted Development Order that is likely to have a significant effect on a European Site that development must not commence until a developer has received written notification of the approval of the local planning authority under Regulation 77. Regulation 77 requires that the local planning authority may approve the development only after having ascertained that it will not affect the integrity of the site.
The process for this is to submit to the planning authority sufficient information for it to enable an assessment to take place. This should include a statement to inform an appropriate assessment, including the opinion of the nature conservation body (Natural England). There is no statutory application form to be completed, but there is a requirement to pay £30 at the time of application.
The Planning Authority will then inform Natural England of the application, who will be given a period to make comments, and the planning authority will take these comments into account.
The Planning authority may approve the development only after having ascertained that it will not adversely affect the integrity of the site.
